North Attleborough Planning Board finds developer violated Gregory Way special permit terms
NORTH ATTLEBOROUGH — July 9, 2026 — North Attleborough Planning Board finds Gregory Way developer in violation of special permit. The board, chaired by Jason Gittel, heard from peer review engineer Janet Bernardo of the Horsley Witten Group, who reported that four of five lots at the Gregory Way open space subdivision have structures — including a swimming pool, basketball court, propane tanks, and stone walls — encroaching on either homeowners association open space or a conservation restriction parcel owned by the town. Staff confirmed the encroachments violate condition 23 of the project's special permit, which requires accessory structures to remain within demise parcel boundaries. Homeowner and attorney Leo Fusekis of 10 Gregory Way told the board the developer, who lives in the development, had represented the project as "95 percent complete" at an August 2025 board appearance while allegedly building the encroaching structures. Gittel was direct: "He owes you what he sold you and he owes you what he agreed to." The developer is scheduled to appear before the board at its July 30 meeting. The board also approved a $312,097.50 bond release for Jeffrey Drive in the Westwood Estates subdivision, recommended town council acceptance of Ronald C. Meyer Drive and Hood Street, and opened a public hearing for NESFAD Inc.'s proposed 20,000-square-foot industrial building at 405 Plain Street, which was continued to July 30 pending peer review.
