Plainville Board of Health denies well setback variance at 1 Fails Place
NORTH ATTLEBORO — July 17, 2024 — The Plainville Board of Health denied a well setback variance Wednesday, ruling that an improperly installed potable water supply at 1 Fails Place did not meet the criteria for relief. The well had been installed approximately 100 feet from its approved location and placed less than 50 feet from the property line, in violation of the town's 50-foot minimum setback standard under Chapter 784-8B2. The board's director told members the site contained feasible area for a compliant well placement, undercutting any hardship claim, and concluded that "the well should have gone where it was approved." No member voted in favor of the variance; all present voted against. The board also acknowledged the resignation of Vice Chairman Dick Aishin, opening a seat on the three-member body; interested residents may file availability cards at Town Hall.
